These terms govern the use of this website and the engagement of services provided by Heirdesk, operating from 3 Jalan Kia Peng, 50450 Kuala Lumpur, Malaysia. By submitting an enquiry or entering into a programme engagement with us, you confirm that you have read and agree to these terms.
1. Definitions
- "Service" — the records location, heirloom cataloguing and estate archive programmes described on this website
- "User" / "you" — any person who accesses this website or engages Heirdesk to carry out a programme
- "We" / "us" / "Heirdesk" — the business operating under the name Heirdesk from 3 Jalan Kia Peng, 50450 Kuala Lumpur
- "Programme" — a defined engagement (Records Location Session, Heirloom Cataloguing Programme or Estate Archive Programme) as specified in writing before work begins
- "Scope document" — the written description of what will and will not be done, produced before each programme begins
2. Acceptance of these terms
By using this website or engaging our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. Engaging us on behalf of an estate or family group means you represent that you have authority to do so.
3. Description of services
Heirdesk provides administrative and descriptive records support. All work is non-regulated: we locate, list, describe, photograph, scan, label and organise. We do not draft, interpret, value for any regulated purpose, advise on legal or financial matters, or file documents with any authority. The scope of each programme is set out in a written scope document produced before work begins.
Services are available to households in Kuala Lumpur and the Klang Valley, with remote elements available for qualifying programmes. Geographic scope is discussed as part of the initial enquiry.
4. Enquiries and engagement
Submitting an enquiry through this website does not constitute a booking or create a contract. An engagement begins only when both parties have confirmed the scope document in writing and a deposit has been received. We reserve the right to decline any enquiry without explanation.
5. User responsibilities
- Provide accurate information when making an enquiry
- Ensure that the household and its contents are accessible during agreed sessions
- Notify us of any items that should not be handled, photographed or listed
- Obtain any necessary permissions from other parties with an interest in the household before engaging our services
- Not use this website for any unlawful purpose
6. Intellectual property
All content on this website — text, design and structure — is the property of Heirdesk or licensed to us. You may not reproduce, redistribute or adapt it without our written permission.
Written outputs produced during a programme (inventories, catalogues, orientation documents) belong to you. We retain no copies after programme close. We may reference the general nature of our work for business purposes but will not identify clients or disclose details of any household's records.
7. Payment
Fees are as stated in the written scope document for each programme, denominated in Malaysian Ringgit (RM). A deposit of 50% is required before work begins. The balance is due on delivery of the written output. Payment is accepted by bank transfer. Receipts are provided on request.
If a household proves substantially larger in scope than originally described, we will discuss any adjustment before continuing. Additional charges are agreed in writing before any additional work is carried out.
Cancellation: If you cancel after the scope document has been agreed and the deposit paid, the deposit is non-refundable. If we are unable to complete a programme for reasons attributable to us, we will refund a fair proportion of fees paid.
8. Confidentiality
We treat all information about a household's records, documents and objects as confidential. We will not disclose details of your engagement to any third party except where required by law. Our data handling practices are set out in the Privacy Policy.
9. Disclaimers
This service is provided on an as-is basis. We make no representation that any output will be complete in the sense that no records remain unfound — only that what was accessible during sessions is recorded. We do not provide legal, tax, financial or valuation advice. Nothing in our outputs should be relied upon as a substitute for qualified professional advice.
10. Limitation of liability
To the extent permitted by Malaysian law, Heirdesk's total liability for any claim arising from a programme engagement is limited to the fees paid for that programme. We are not liable for indirect, consequential or economic losses. Nothing in these terms excludes liability for fraud or for death or personal injury caused by our negligence.
Force majeure: we are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, illness or government orders. We will notify you promptly and, where a programme cannot be completed, arrange a fair refund or reschedule.
11. Indemnification
You agree to indemnify us against any claim arising from information you provided that was inaccurate, or from your failure to disclose relevant limitations on access to household contents.
12. Termination
Either party may end a programme engagement by written notice. If you terminate after sessions have begun, fees for completed sessions are due. If we terminate because of conduct on your part that makes continued work unreasonable, the same applies. If we terminate for any other reason, we will refund fees for sessions not yet carried out.
13. Dispute resolution
These terms are governed by the laws of Malaysia. In the event of a dispute, we ask that both parties first try to resolve it informally by writing to [email protected]. If informal resolution is not possible within 30 days, disputes will be referred to the courts of Malaysia sitting in Kuala Lumpur.
14. General provisions
- Entire agreement: These terms, together with the written scope document for each programme, constitute the entire agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions continue to apply.
- Waiver: Failure to enforce a provision on one occasion is not a waiver of that provision.
- Assignment: You may not assign your rights under these terms without our written consent.
15. Changes to these terms
We may update these terms from time to time. The date above will be updated when changes are made. For programmes already in progress under a signed scope document, the terms in force at the time of signing apply unless we agree otherwise in writing.
